House Bill 457 (PA 95-0239) makes Salvia Divinorum a Schedule I controlled substance. The bill, similar to one sponsored by Senator Millner in the Senate (SB 226), also bans the use of the seeds, extract or other derivatives of the plant.
“I would like to thank the DuPage County Sheriff for making me aware of this dangerous herb, and how it negatively affected one of his employee’s children, who suffered symptoms similar to that of LSD and severe depression after using the herb,” Millner said. “That prompted me to do some careful research which led me to believe getting this substance off the street was the right thing to do.”
Under the bill, anyone convicted of possessing Salvia Divinorum is subject to a Class 4 felony conviction. Anyone who manufactures, delivers, or possesses with intent to manufacture or deliver Salvia Divinorum is subject to a Class 3 felony conviction.
“I would like to thank Representative Dennis Reboletti (R- Addison) for his hard work on this bill. I am thankful we have taken this major step forward in keeping people safe from the dangers of using this substance,” Millner said.
The bill, which passed both houses of the General Assembly unanimously, was signed into law Friday August, 17th.
